BER Compliance
Every commercial property offered for sale or letting needs a valid BER, and the rating must appear in all advertisements. Failure to comply is an offence carrying a fine of up to €5,000 on summary conviction under S.I. No. 243 of 2012. Separately, the recast EU Energy Performance of Buildings Directive (EU) 2024/1275 requires Ireland to set national minimum energy performance standards for non-residential buildings by 1 January 2027, with the worst-performing 16% of the stock to be renovated by 2030 and 26% by 2033.
